Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the ShiftStreak service ("Service") provided by PG Foodies s.r.o.

Provider: PG Foodies s.r.o., ID: 05518733, VAT: CZ05518733, Urxova 6, 186 00 Prague, Czech Republic ("Provider")

User: Any legal entity or individual using the Service ("User")

2. Service Description

ShiftStreak is a cloud-based time tracking application with gamification features, designed primarily for restaurants and hotels. The Service includes:

• Mobile application for employees (iOS, Android)
• Web admin panel for managers
• Gamification features (streaks, badges, leaderboards)
• Data export and statistics

3. Registration and Account

Registration is required to use the Service. The User agrees to:

• Provide accurate and current information
• Protect login credentials from unauthorized use
• Immediately notify the Provider of any unauthorized access

4. Pricing Plans and Payments

4.1 Free Plan

The Free plan is available for up to 5 employees with no time limit.

4.2 Paid Plans

Paid plans (Starter, Pro, Business) are billed monthly or annually in advance. Prices are listed on the Pricing page.

4.3 Trial Period

All paid plans include a 30-day free trial. No credit card is required during the trial period.

4.4 Payment Terms

• Payments are processed through Stripe payment gateway
• We accept credit cards (Visa, Mastercard)
• Invoices are issued automatically after each payment
• Prices are listed in EUR excluding VAT (VAT will be added according to applicable legislation)

5. User Rights and Obligations

The User is entitled to:

• Use the Service in accordance with these Terms
• Export their data at any time during the contract
• Cancel the account at any time, effective at the end of the billing period

The User agrees to:

• Not use the Service for illegal purposes
• Not interfere with the technical infrastructure of the Service
• Not share login credentials with third parties

6. Provider Rights and Obligations

The Provider agrees to:

• Ensure Service availability of at least 99.5% per month
• Protect User data in accordance with GDPR
• Notify of planned maintenance in advance
• Provide technical support in Czech and English

The Provider is entitled to:

• Suspend the Service in case of Terms violation
• Modify Service features with prior notice
• Adjust prices with 30 days notice

7. Data Protection

Processing of personal data is governed by the separate Privacy Policy, which is an integral part of these Terms.

8. Limitation of Liability

The Provider is not liable for:

• Damages caused by improper use of the Service by the User
• Outages caused by third parties (internet, hosting)
• Data loss caused by the User
• Indirect damages or lost profits

Maximum liability is limited to the amount paid by the User in the last 12 months.

9. Termination

9.1 Termination by User

The User may terminate the contract at any time through the admin panel. The Service will remain available until the end of the current billing period.

9.2 Termination by Provider

The Provider may terminate the contract with 30 days notice, or immediately in case of serious Terms violation.

9.3 After Termination

After termination, User data will be available for export for 30 days, after which it will be deleted.

10. Final Provisions

• These Terms are governed by the laws of the Czech Republic
• Any disputes will be resolved by competent courts in the Czech Republic
• The Provider reserves the right to modify these Terms with 30 days notice
• Changes will be announced via email and on the website
